1. Scope and acceptance
These terms govern access to and use of the Poquelin application (app.poquelin.ai), published by Company name (“Poquelin”, “we”), by any organisation that opens an account (“the customer”, “you”) and by the users it invites.
Poquelin is exclusively for professionals: newsrooms, press publishers, online media and agencies acting for them. By creating an account you declare that you act in the course of your professional activity, that you have authority to bind your organisation, and that you accept these terms and the privacy policy.
2. The service
Poquelin is an online editorial platform: monitoring (Reader), planning (Planner), AI-assisted writing (Editor, Social Magic), media management (Media library), audience and revenue measurement (Analytics), web notifications (Push) and social publishing (Social Creator), connected to the sites and accounts you link. Functions and volumes per plan are detailed on the pricing page.
We develop the service continuously. A function may be added, changed or removed; we give at least 30 days’ notice before removing a substantial function of your plan.
Poquelin provides tools, not an editorial service: the content published from the platform is yours and remains yours, with the responsibility that goes with it (section 6).
3. Account, organisation and users
An account is personal. It gives access to the organisations you are a member of, with the permissions your role defines there. The organisation is responsible for the users it invites, the roles it assigns and what they do on the platform. You inform us without delay of any unauthorised use of an account.
Sign-in uses a one-time code sent to your email address, or your Google account. You are responsible for access to that mailbox.
4. Plans, trial and billing
Each organisation subscribes to a plan. Plans, their volumes (sites, members, articles, notifications, posts…) and their options are those on the pricing page on the day of subscription; the published pricing may change for future subscriptions.
Trial: when an organisation is created, you get 14 days of the Pro plan, with no payment method. At the end of the trial, without a subscription, the organisation moves to the free plan within its volumes.
AI functions consume usage units (“Poquelin tokens”) included in each plan and renewed every period. Unused volumes do not carry over. Add-ons (“boosts”) let you add more.
Billing: subscriptions are paid in advance, monthly or yearly, by card through our payment provider. An upgrade takes effect immediately, pro rata; a downgrade takes effect at the end of the current period. Prices are exclusive of tax. If a payment fails, we notify you and may suspend access after a reminder; data is kept during the suspension.
Cancellation: you cancel at any time from the organisation settings; the subscription runs until the end of the paid period, with no refund for the period started. As Poquelin is reserved for professionals, the consumer right of withdrawal does not apply.
5. Connected sites, accounts and services
You connect to Poquelin your own sites (WordPress or API), your social accounts (Facebook, Instagram, Threads, X, TikTok, Pinterest, Bluesky…), your Google services (Ad Manager), and you install, where relevant, the Poquelin script on your sites. You warrant that you hold the necessary rights on each of them.
Each connected service remains governed by its own terms, which you undertake to comply with: the networks’ publishing rules, API usage limits, advertising platform policies. Some connection methods offered do not rely on an official API of the platform concerned; by enabling them you do so knowing that platform’s terms and under your own responsibility. Poquelin is not liable for suspensions, limitations or changes decided by a third-party service.
Connected access is stored encrypted and used only for the operations you request. You can revoke it at any time.
6. Content, sources and artificial intelligence
Your content: everything you create or upload on the platform (articles, briefs, media, notifications, posts, voice profiles) belongs to you. You grant us a limited, non-exclusive licence to host, process, transmit it to the services you connect and back it up, for the duration of the contract and solely to provide the service.
Your sources: the links, feeds, social posts, documents, photos and videos you submit as sources are analysed for you (extraction, summary, transcription) and are not republished by Poquelin. You are responsible for the editorial use you make of these sources and of the content produced from them: copyright, quotation rights, image rights, compliance with the terms of the originating sites and platforms. Images from the integrated banks are subject to each bank’s licence.
Generated content: AI functions produce proposals from your sources, your instructions and your voice profile. They may contain errors, approximations or unsuitable wording. You review, verify and take responsibility for any content before publishing it; Poquelin is neither the author nor the publisher of what you publish. You ensure compliance with the obligations that apply to your publication, including, where applicable, informing your readers about the use of AI.
Prohibited content: you do not use Poquelin to produce or distribute unlawful content (defamation, incitement to hatred, invasion of privacy, infringement), to send unsolicited notifications or posts, or to collect data without a legal basis.
7. Your readers: the Analytics tag and Push notifications
When you install the Poquelin script on a site, you are the controller of its visitors’ data; Poquelin processes it on your behalf (section 10). You undertake to inform your readers of the audience measurement in your privacy policy (a template text is provided in the application) and to obtain their agreement for notifications, which the browser itself requests.
The Analytics tag is designed without cookies or persistent identifiers so as to qualify as a measurement tool exempt from consent under the French CNIL guidelines; it is up to you to check that qualification with your data protection officer, according to your site and your country.
8. API, SDK and access keys
API keys and the SDK let you integrate Poquelin with your own systems. A key binds the organisation that issues it: you keep it secret, restrict it to the rights needed and revoke it as soon as it is no longer useful. We may rate-limit calls to protect the service.
9. Availability, support and security
We make our best efforts to keep the service accessible at all times, without a contractual availability guarantee. Interruptions may occur for maintenance (announced when possible) or for causes beyond our control, including the unavailability of a connected third-party service.
Data is backed up daily, encrypted, and kept for 30 days. Support is by email at contact email address. With your agreement or to resolve an incident, a Poquelin administrator may enter your workspace for a limited time; each access is logged.
10. Personal data and data processing agreement
For your account data and billing, Poquelin is the controller; the privacy policy applies.
For the personal data you process in the tools (your content, your sources, your subscribers, your sites’ visitors), you are the controller and Poquelin is your processor within the meaning of Article 28 of the GDPR. This section constitutes the data processing agreement:
- We process this data only on your documented instructions — these terms and your actions in the application — to provide the service, and for no other purpose.
- Our authorised staff are bound by confidentiality.
- We implement the security measures described in the privacy policy (European hosting, encryption, access control, backups, logging).
- We use the sub-processors listed in the privacy policy; we inform you of any change at least 30 days before it takes effect, and you may object by terminating if the change is detrimental to you.
- We help you respond to data subject requests and meet your security and impact assessment obligations, as far as possible and given the nature of the processing.
- We notify you of any personal data breach without undue delay after becoming aware of it.
- At the end of the contract, you export your data from the application; we delete the rest at the end of the 30-day bin period, unless a legal retention obligation applies.
- We make available the information needed to demonstrate compliance with these obligations and allow reasonable audits, at your expense, with 30 days’ notice and at most once a year.
- Transfers outside the European Union are governed by the European Commission’s standard contractual clauses.
11. Intellectual property
Poquelin (software, trademarks, interface, demonstrations, documentation) remains our property. The contract gives you a non-exclusive, non-transferable right of use limited to the duration of the subscription. You do not reverse-engineer or resell it without written agreement. Feedback and suggestions you send us may be used freely to improve the service.
12. Liability
Poquelin is bound by an obligation of means. Our liability is limited to proven direct damages and capped, all causes combined, at the amounts you paid us in the twelve months preceding the event giving rise to it. We are not liable for the content you publish, for decisions taken on the basis of the figures or proposals the service provides, for loss of revenue, or for the acts of connected third-party services.
You indemnify us against any third-party claim related to the content you produce or publish through Poquelin, the sources you submit and the data you process.
13. Term, suspension and end
The contract takes effect when the organisation is created and lasts as long as it exists. We may suspend an account or an organisation in case of serious breach (unlawful content, security breach, persistent non-payment, API abuse), after formal notice where the situation allows. You may close your organisation at any time; export and deletion are described on the data deletion page.
14. Changes, governing law and disputes
We may change these terms; the version in force is the one published on this page, dated at the top. A substantial change is announced at least 30 days before it takes effect; continuing to use the service after that date constitutes acceptance.
These terms are governed by French law. Failing an amicable settlement, any dispute falls under the jurisdiction of the competent courts of city of the competent court, France, notwithstanding multiple defendants or third-party claims.
